Probate: A grueling, neverending process that tears families apart. When someone passes away, there are numerous different things that the family has to deal with. If the deceased only had a Will when they passed, their entire estate would have to go through probate, which means that the Will must be proven in a court of law. This process authenticates the Will and demonstrates that it is a valid document. While this may sound good on paper, the process can take over 18 months in court. You can only distribute your assets to the proper beneficiaries during this process. Avoiding probate is a necessity.

The Solution to Avoiding Probate: Living Trusts

Now that probate has been explained, how can you avoid it? One of the best ways to do so is to create a Living Trust. A fully funded living trust will protect your estate from probate when you die, allowing you to pass your estate on to your family or other beneficiaries. It accomplishes this by titling all your assets in your Trust name, naming a trusted individual as your Successor Trustee, who follows your wishes and distributes your property efficiently and inexpensively, outside the court’s involvement.
